Andrej Babiš, the self-proclaimed billionaire who won the recent parliamentary vote, has refused to offload his extensive business interests, while asserting he will resolve a ethical dilemma that could block him from taking the position of head of government.

Position on Corporate Empire

Babiš, whose political movement emerged victorious in the October vote but did not secure a majority in parliament, stated in a online statement that he would not divest his Agrofert group, which operates in farming, food production, and chemicals.

“I have consistently said I will never sell Agrofert. I have repeatedly said I will resolve the ethical issue in compliance with national and European laws,” Babiš commented. “This is not like selling a roll in a bakery.”

President's Requirement

The Czech president, Petr Pavel, stated that the 71-year-old political figure must clarify openly how he will remove ethical conflicts stemming from his business activities before assuming the role of prime minister.

The national charter “clearly mandates the head of state to take into account the possible emergence of a ethical issue and the possibilities for its resolution” when appointing cabinet members, Pavel's office explained.

The president “wants it to be clear in what precise manner Andrej Babiš will meet his constitutional and legal obligations”, the announcement said, stating that Pavel was prepared to appoint Babiš as prime minister “immediately” once the matter was resolved.

Corporate Activities and Regulatory Concerns

Babiš's numerous companies, mostly under the Agrofert umbrella, function in the Czech Republic and other central European states, receiving substantial funds in domestic and European farming and other subsidies, as well as public contracts.

Under national legislation, cabinet members are barred from obtaining state support or contracts. The anti-corruption watchdog Transparency International has stated that to avoid a ethical breach, Babiš must either sell, refuse government deals, or stay out of public office.

Past Term and Present Plans

Babiš said he would “follow the regulations” if selected as prime minister, but did not want to explain how in beforehand because the issue was “an extremely sensitive and private affair for me, and journalists will always criticise me regardless”.

During his initial tenure as premier, from 2017 to 2021, Babiš faced several legal battles and an European inquiry over potential conflicts of interest. He placed his assets into trust funds, while retaining some influence over them.

A court and the European Commission both ruled that this did not suffice. Babiš confirmed recently that he was again the exclusive proprietor of Agrofert and maintained he was “taking steps” to avoid a conflict of interest, but declined to disclose specifics.

Governing Agreement and International Consequences

The wealthy politician has signed a coalition agreement with two rightwing fringe parties, the ultra-conservative, pro-Russian SPD, which has called for a public vote on leaving the EU, and the Motorists for Themselves, which has mainly opposed the EU’s Green Deal.

The new government, if confirmed, is likely to bolster the populist bloc in the region and could challenge backing from Western nations for Ukraine – even though Babiš has contacted Ukraine’s president, Volodymyr Zelenskyy, to confirm of the nation's backing.

Pavel, who as head of state shares responsibility for international relations, also demanded that the coalition’s programme include a declaration on the government’s position on the conflict in Ukraine, including a commitment to meeting alliance duties.

The president has earlier said he would not approve any ministerial nominees who might question the nation's international alliances, a condition that the far-right SPD has indicated it will satisfy by nominating independent technocrats.
